You are entitled to download at no cost, a low or high resolution image, for your layout or draft design purposes, however by downloading an image, clicking on (Downloaded Image) you agree to be bound by the Downloading license as it appears more fully below. XYNYTH reserves the right to change the terms and conditions of this agreement at anytime.
XYNYTH grants you a non-exclusive, non-assignable, non-transferable, revocable license to copy a Downloaded XYNYTH Image and use this image for the limited purpose of promoting XYNYTH products to your customers or clients. You are not granted any rights to use a XYNYTH Image for any other purpose, without the express written permission from XYNYTH Manufacturing Corp. Except for the rights granted in this License, you have no interest, right, title or property to any Downloaded XYNYTH Images.
The images must be used in their original formats and design. A Downloaded XYNYTH Image may not be altered in any way, except to enlarge or shrink the image. You must not offer for sale, distribute or sub-license these images (or a collection of) without the express written permission from XYNYTH Manufacturing Corp.
XYNYTH does not make any representation or warranty with respect to the use of names, signs, logos, trademarks, copyright, designs, or any other likeness which appears in a Downloaded Image. You must ensure that all necessary rights or licenses that may be required are obtained prior to publication, reproduction or other use of a Downloaded Image.
You must notify XYNYTH of any activity of anyone of which you become aware, which infringes, or may infringe, the copyright in any Downloaded Image. You agree to provide assistance to XYNYTH as reasonably required if there is infringement of the copyright in the Downloaded Images.
XYNYTH will not be liable to you in any way for any loss, costs or damages of any kind, including loss of profits in any way arising out of the use of the Downloaded Image and this Downloading license. XYNYTH will not be liable for any willful or negligent act on its part, irrespective of whether XYNYTH had contemplated the possibility of this occurring or not, for any computer virus contained in a Downloaded Image.
A link to this site is required where an image is used. Acceptable credits include 'image: www.xynyth.com' or a hyperlink to the URL'http://www. xynyth.com'. The credit shall be located in a suitably readable font on the same page as the image.
